On May 18, the United States Department of Labor adopted new regulations changing the criteria for classifying an employee as exempt from overtime pay. The new regulation goes into effect on December 1, 2016 and will have an impact on employers who currently classify any employees as exempt. As usual, the questions regarding who is covered and what may be included in determining the salary threshold are not as simple and direct as most employers would prefer.
